The Accra Circuit Court has issued bench warrants for the arrest of managing directors (MDs) and heads of 30 institutions and companies for allegedly defaulting in the payment of the Social Security and National Insurance Trust (SSNIT) contributions of their staff.
The defaulters have allegedly also refused to fulfil negotiated terms between them and SSNIT for the settlement of their indebtedness, amounting to GH¢589,392.59.
The Accra Fast Track High Court has also issued a writ of summons to the Chief Executive Officer of Gocrest Security Limited (GSL), Mr George Aggudey, for defaulting in the payment of GH¢1,678,457.85, being SSNIT contributions of his employees. According to the trust’s statement of claim, in October 2006, after several appeals to the management of GSL to settle its indebtedness, which yielded no result, a criminal summons was issued against Aggudey at the Circuit Court for the recovery of the arrears.
However, the case was withdrawn from the court after he had pleaded for an out-of-court settlement and given all the assurances to settle the debt. In February 2008, the company was offered the opportunity to negotiate with SSNIT to pay GH¢1,237,521.36 which was its debt as of December 2007.
A negotiated agreement was signed by the two parties for the settlement of the arrears by monthly instalments. But the company failed to abide by the terms of the agreement, resulting in the abrogation of the negotiated agreement in March 2009.
Three cheques issued by the company for the settlement of the monthly instalments were dishonoured by the bank and are still in the possession of SSNIT, while persistent demand for the company to redeem the said cheques had proved futile.
An updated inspection conducted by SSNIT into the books of Gocrest revealed that the company had refused, failed and/or neglected to pay SSNIT contributions of GH¢691,667.73 (for the first tier) and GH¢24,749.56 (for the second tier, totalling GH¢716,307.29 as of June 2010, while the unpaid contribution for the period ending June 30, 2010 was GH¢1,017,248.30.
Among the personalities to be dragged before the Circuit Court, presided over by Mrs Georgina Mensah-Datsa, are Mr George Oppong, the MD of Modern Car Park, Airport, who owes GH¢65,680; Sally Kanbonaba, Monte Carlo Grand Cafe, GH¢8,441; Francis Dowetin, Datus Complex School, GH¢61,389.37; George Tetteh Nettey, Geonette Enterprise, GH¢10,901; Edmund Torto, Eton Complex School, GH¢2,709.83; David Somuah, Pacific Trust (Gh) Ltd, GH¢413.23, and Refhold Pappoe, Zuriel Refrigeration and Electrical Eng. Ltd, GH¢3,727.20.
